The College alleged that the Member engaged in professional misconduct by: engaging in conduct or performing an act, relevant to the practice of nursing that, having regard to all the circumstances, would reasonably be regarded by members of the profession as disgraceful, dishonourable or unprofessional in that the Member failed to complete the Specified Continuing Education or Remediation Program ordered by the Inquiries, Complaints and Reports Committee (ICRC). 

The Member did not attend the hearing and he was found to have engaged in professional misconduct, as alleged, that would reasonably be regarded by members of the profession as dishonourable and unprofessional. The Member’s conduct showed a lack of professionalism and an unwillingness to be governed by the College. 

The mitigating factors included that the Member had no prior discipline history with the College and the aggravating factor was that the Member had many opportunities to comply with the ICRC’s order and chose not to do so. 

The Panel ordered an oral reprimand, a four-month suspension, and terms, conditions and limitations on the Member’s certificate of registration, including attending two meetings with a Nursing Expert.
