The Member admitted that he engaged in professional misconduct by: sexually abusing a client when he engaged in sexual intercourse with the client; and engaging in conduct or performing an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional.

The College and the Member presented the Panel with a Joint Submission requesting an Order that included an oral reprimand, revocation of the Member’s certificate of registration and reimbursement to the College for funding, up to the amount of $5,000, provided to the Client for therapy and counselling under the program required by s. 85.7 of the Health Professions Procedural Code, if the Client accessed the program.

The Panel accepted the Joint Submission on Order and concluded that the proposed penalty was reasonable and in the public interest.
