The Member admitted that she engaged in professional misconduct by: contravening a standard of practice of the profession or failing to meet the standards of practice of the profession by using excessive force to restrain a client by striking him; abusing the client emotionally and physically when she used excessive force to restrain him; and engaging in conduct or performing an act, relevant to the practice of nursing that, having regard to all the circumstances, would reasonably be regarded by members of the profession as disgraceful, dishonourable and unprofessional.
The College and the Member presented the Panel with a Joint Submission requesting the Panel to make an Order that included an oral reprimand, a four-month suspension, and terms, conditions and limitations on the Member’s certificate of registration, including attending two meetings with a Nursing Expert and employer notification for 12 months.
The mitigating factors included: the Member voluntarily undertook remedial work; had no prior discipline history; and expressed remorse. The aggravating factors included the seriousness of the Member’s conduct.
The Panel accepted the Joint Submission on Order and concluded that the proposed penalty was reasonable and in the public interest.
