Privacy, confidentiality and your nursing practice

On November 1, 2004, new Ontario privacy legislation was enacted that affects how nurses and other health care providers handle private and confidential health information provided by clients. This section contains links to College information that will help nurses understand this legislation, as well as government resources that will assist them in meeting expectations around the collection, use and disclosure of personal health information.

The two new pieces of legislation are the Personal Health Information Protection Act (PHIPA) and the Quality of Care Information Protection Act. (QOCIPA).

PHIPA sets consistent rules for the management of personal health information and outlines clients' rights regarding the use of their personal health information.

QOCIPA provides broad protection to quality of care information produced by health care facilities or regulatory bodies like CNO. The Office of Ontario's Privacy Commissioner has posted downloadable versions of these pieces of legislation on their website.
