The Member was a Nurse Practitioner in a Clinic who treated a family, Patients A and B, the parents, and Patient C, the child of Patients A and B.  The Member was alleged to have engaged in professional misconduct when she engaged in a personal relationship with both Patients A and B, and engaged in a sexual relationship with Patient B while the Member was aware that Patient A was distressed by their relationship.  The Member was also alleged to have failed to transfer the care of Patients A, B and C while maintaining a sexual/personal relationship with Patient B. 

The Member was not present or represented by legal counsel, so the hearing proceeded in her absence.

The Panel found the Member guilty of some of the alleged misconduct, and in particular, the following:

  • sexually abusing a patient;
  • contravening a standard of practice of the profession or failing to meet the standards of practice of the profession;
  • verbally and emotionally abusing a patient; and
  • engaging in conduct relevant to the practice of nursing, that, having regard to all the circumstances would reasonably be regarded by members as disgraceful, dishonourable and unprofessional.

The Panel made an order that included the following:

  • an oral reprimand; and
  • revocation of the Member’s certificate of registration.

The Panel noted that this order was mandatory under s. 51(5) of the Health Professions Procedural Code.
