Facts

This case involved clinical allegations and allegations that the Member had sexually harassed or behaved unprofessionally towards three of his former colleagues. 

The Member admitted that, while working as a Registered Nurse on a night shift in April 2019 at a hospital facility, he failed to notify the Most Responsible Physician of a patient’s low urine output as required by a physician’s order, and administered boluses of Ringer’s Lactate to the patient without a physician’s order.

The Member denied behaving unprofessionally or sexually harassing his three former colleagues. The Panel concluded that the Member’s conduct towards two of his colleagues was unprofessional but did not amount to sexual harassment. 

Discipline Committee’s Findings 

A panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:

  • contravened a standard of practice of the profession or failed to meet the standards of practice of the profession; and
  • engaged in conduct, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as dishonourable and unprofessional. 

Discipline Committee’s Order 

The Panel accepted the Joint Submission on Order presented by the College and the Member, and made an order that included the following: 

  • an oral reprimand;
  • a 4-month suspension; 
  • terms, conditions and limitations, including:
     
    • attending a minimum of 2 meetings with a Regulatory Expert; and
    • employer notification for 18 months.
